This course will provide information on British Columbia’s Builders Lien Act and how it applies to various industry stakeholders, including Owners, General Contractors, Subcontractors, and Suppliers.  This course will assist participants in obtaining an understanding of the following key learning objectives:

  • Understand the purpose of the Builders Lien Act, who it applies to, and how it works for different industry stakeholders.
  • Understand the process for filing and enforcing a lien.
  • Understand how to apply the statutory builders lien holdback for Owners, Contractors, and Subcontractors.
  • Receive a primer on key anticipated changes to the Builders Lien Act being proposed based on recommendations made to the British Columbia Law Institute.
  • Review key cases interpreting and applying the Builders Lien Act in British Columbia.

Presented by: Andrew D.R. Delmonic 

Andrew D.R. Delmonic is a partner with Kuhn LLP. He has experience representing clients in a variety of litigation matters before the Provincial Court, Supreme Court, and Court of Appeal of British Columbia. Andrew’s practice is primarily focused on business litigation, and he has assisted clients in resolving a broad range of issues, including those relating to contracts, construction, builders’ liens, employment, debt collection, and shareholder and partnership disputes.  Andrew also assists clients in preparing and revising contracts, including drafting and advising on construction contracts and contracts of employment. Andrew has regularly written articles for publication in the field of construction law.

Andrew volunteers his time as a Board Member with HAVAN, and is an instructor for the Construction Law course provided through The Canadian Home Builders’ Association of British Columbia.
